最低薪金执行指南 Guidelines on Implementation of Minimum Wages

The Ministry of Human Resources has announced the Guidelines on Implementation of Minimum Wages which clarify the definition of Minimum Wages (MW) and calculation of commission and salary of workers.

The Minimum Wages Order 2012 gazette on 16th July 2012 will come into operation on 1stJanuary 2013 for employers who employ more than five employees (including foreign workers), and by 1st July 2013 for employers who employ five employees or less.

The minimum wage set for West Malaysia is RM900 per month or RM4.33 per hour while for East Malaysia is RM800 per month or RM3.85 per hour.

For those employers who wish to apply for deferment, written application must be submit to National Wage Council before the following deadlines:
a) For employers who employ more than five employees - before 2nd Oct 2012;
b) For employers who employ 5 employees or less – before 1st Apr 2013

All written applications must be submitted together with the following documents:
i) Company Information as registered with Company Commission Malaysia (SSM);
ii) Audited Financial Report for recent 3 years;
iii)Number of local workers and foreign workers together with their salaries for the most recent month

最低薪金执行指南

人力资源部已公布落实最低薪金的执行指南,阐明日薪雇员的最低薪金、无基薪雇员的薪制及佣金等详情。

于2012年7月16日在宪报上颁布的2012最低薪金法令,将在2013年1月1日起正式生效,实施于所有领域聘请超过5名员工(包括外劳)的雇主。至于聘请5名员工或以下的雇主,有关法令则于2013年7月1日起生效。

在这项法令下,西马的每月最低薪金是RM900或每小时RM4.33,东马则是每月RM800或每小时RM3.85。

欲申请展延的商家,请在下列截止日期前,呈交书面申请予全国薪金咨询理事会:
a)聘请超过5名员工者 – 截止日期为2012年10月2日;
b)聘请5名员工或以下者 – 截止日期为2013年4月1日

所有申请必须同时附上以下文件:
i) 向公司委员会 (SSM) 注册的公司资料;
ii) 近3年来经审查过的公司财务报告;
iii)最近一个月所聘请的本地员工及外劳人数,以及各自的薪酬
